1. Who we are and your agreement
LaunchPulse is operated by Vibechooser PTY Ltd, a company based in South Africa ("we", "us"). You are contracting with Vibechooser PTY Ltd for use of the service. By creating an account or continuing to use LaunchPulse, you agree to these terms. You must be of legal age to enter a binding agreement and, if using the service for an organisation, have authority to bind it.
For service questions, contact hello@vibechooser.com.
2. Accounts and access
Provide accurate account information, keep it up to date, protect your sign-in credentials and notify us of suspected unauthorised access. You are responsible for activity under your account. We grant you a limited, non-exclusive, non-transferable right to use LaunchPulse within your selected plan. Do not resell access, reverse engineer the service where prohibited by law, or bypass plan limits or security controls.
3. Plans, payments and cancellations
The Free plan includes one marketing campaign generation and one waitlist page, without CSV export. Pro is USD $19 per month and includes unlimited AI generations, unlimited active waitlist pages and CSV lead exports, subject to these acceptable-use terms. Any applicable taxes and the final amount are shown at checkout. Pro renews monthly until cancelled.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. You can manage or cancel your subscription using Manage billing in your Profile tab or through paddle.net. Cancellation stops future renewals; access normally continues until the end of the paid period. See our Refund Policy for refund requests. Mandatory consumer rights remain unaffected.
4. Acceptable use
You must not use LaunchPulse to:
- Break the law, commit fraud, send spam or collect personal information without the necessary permissions.
- Infringe copyright, trademarks, privacy or other rights, or impersonate people deceptively.
- Create or distribute illegal content, hateful or abusive material, exploitative sexual content, or harmful or deceptive deepfakes.
- Create malware, interfere with security, probe systems without permission, scrape the service without authorisation, or disrupt other users.
- Jailbreak AI systems, circumvent content filters, or otherwise evade safeguards or access restrictions.
Waitlist owners are responsible for their page content, the lawful collection and use of subscriber data, required notices and permissions, and complying with marketing and data-protection laws.
5. AI inputs and outputs
You are responsible for your prompts, for having the rights and permissions to provide input content, and for how you use generated outputs. Do not submit confidential or sensitive personal information unless you have authority and an appropriate legal basis to do so. AI output may be inaccurate, misleading, incomplete, non-unique or infringing. Review and verify all output before publishing. Outputs are not a substitute for regulated professional advice, including legal, medical or financial advice, without qualified oversight.
You retain rights in your inputs. As between you and us, you may use generated outputs to the extent permitted by applicable law and third-party rights; we do not claim ownership of your inputs or generated campaign copy. We cannot guarantee outputs are protectable by copyright or exclusive to you. You grant us a limited licence to store, process and transmit your content solely to provide, secure and maintain the service, including through our AI service providers.
6. Ownership and rights complaints
Vibechooser PTY Ltd retains ownership of LaunchPulse and its software, documentation, branding and other service intellectual property. These terms do not transfer that ownership.
Rights holders may report suspected infringement to hello@vibechooser.com, identifying the protected work, the relevant page or content, the basis of the complaint and their contact details. We may remove or restrict disputed content while assessing a complaint and suspend or terminate accounts for repeated or serious infringement.
7. Moderation and ending access
We may refuse or filter AI outputs, remove or restrict content, and suspend or terminate access for material breach, non-payment, security or fraud risks, or repeated or serious policy violations. Where reasonable and lawful, we will explain the action and provide an opportunity to address it. Serious risks may require immediate action. Contact us to request a review or discuss access to your data following suspension or termination.
8. Availability and liability
We work to provide a reliable service but do not guarantee uninterrupted, error-free performance or any particular launch result. To the extent permitted by law, the service is provided as available without implied warranties of merchantability or fitness for a particular purpose. We are not responsible for indirect or consequential losses from your use of the service. Nothing in these terms excludes liability that cannot lawfully be excluded, including fraud or mandatory consumer protections.
9. Privacy, changes and governing law
Our Privacy Notice explains how we handle personal data. We may update these terms and will communicate material changes before they take effect where required by law. The effective date above identifies the current version. These terms are governed by South African law, subject to any mandatory rights and jurisdiction protections that apply where you live. Please contact us first to try to resolve a dispute.
